Effective date: January 1, 2026
By accessing or using the website located at elmirageasphaltpaving.com, or by engaging Vertex El Mirage Asphalt Paving ("Company," "we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website or our services.
These terms apply to all visitors to the website and to all customers who engage the Company for asphalt paving or related services.
Vertex El Mirage Asphalt Paving provides asphalt paving, sealcoating, crack sealing, pothole repair, parking lot paving, driveway paving, grading, drainage solutions, and related services for residential and commercial properties in El Mirage, AZ and the surrounding West Valley area.
The specific scope, materials, and timeline for any project are defined in the written estimate or contract provided to the customer prior to work beginning. Services performed are limited to what is described in that written agreement. Verbal representations not reflected in the written estimate are not binding on the Company.
Estimates provided by the Company are based on conditions observed at the time of the site visit and the information provided by the customer. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
If site conditions differ materially from what was observed at the time of the estimate - such as hidden base failures, unforeseen drainage issues, or subsurface obstructions - the Company reserves the right to revise the estimate before proceeding. Any revisions will be discussed with and agreed to by the customer in writing before additional work begins.
Pricing is subject to change based on material costs, labor availability, and other market conditions. An accepted written estimate locks in the price for the agreed scope of work.
Scheduling is confirmed when both parties agree to a start date in writing or by phone. We will contact you prior to the scheduled work date to confirm access to the property and any requirements for clearing the work area.
Weather, equipment issues, or other circumstances outside our control may require rescheduling. We will notify you as promptly as possible if a delay is necessary, and we will work with you to find an alternative date.
If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a rescheduling fee if materials were ordered or crews were dispatched specifically for your project.
Payment terms are stated in the written estimate or contract. Unless otherwise agreed in writing, a deposit may be required before work begins, with the balance due upon project completion. Full payment is due at completion unless alternate terms have been agreed to in advance.
Accepted payment methods are described in the estimate or contract. Late payments may be subject to a late fee as specified in the contract. The Company reserves the right to place a lien on the property in accordance with Arizona law in the event of non-payment.
We stand behind the quality of our workmanship. Any warranty terms for a specific project will be stated in the written estimate or contract. Where no specific warranty is stated, we warrant that the work will be performed in a workmanlike manner consistent with industry standards.
Warranties do not cover damage caused by acts of nature, extreme weather events, improper use, third-party modifications, failure to follow recommended maintenance schedules, or pre-existing conditions that were not within the scope of the contracted work.
The website and any information provided on it are offered "as is" without warranty of any kind. We make no representations that the information on this website is accurate, complete, or current.
To the fullest extent permitted by Arizona law, the Company's liability for any claim arising from services rendered or the use of this website is limited to the amount paid by the customer for the specific service giving rise to the claim.
The Company is not liable for indirect, incidental, consequential, or punitive damages of any kind, including but not limited to loss of use, loss of revenue, or damage to property not directly caused by our work.
If a dispute arises between you and the Company, we encourage you to contact us directly to resolve the matter. Most issues can be addressed quickly through direct communication.
If a dispute cannot be resolved through direct communication, both parties agree to attempt to resolve it through mediation before pursuing litigation. Mediation will be conducted in Maricopa County, Arizona.
Any legal action arising out of or relating to these terms or services provided by the Company shall be brought in the appropriate court of Maricopa County, Arizona.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
We reserve the right to update or modify these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page. Your continued use of the website or our services after any changes constitutes acceptance of the revised terms.
We encourage you to review these terms periodically.
